By accessing or using the Hijaaz Latheef platform, website (hijaazlatheef.com), APIs, or any associated services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and Acceptable Use Policy.
Hijaaz Latheef provides a business-to-business ("B2B") software-as-a-service platform designed for property management firms, commercial landlords, and facility operators. The Service enables clients to:
The Service is not an email marketing platform. All communications facilitated through Hijaaz Latheef are strictly transactional and triggered by real events within the property management workflow.

Violation of these prohibitions may result in immediate account suspension or termination, as described in Section 13.
Service fees are based on the pricing plan selected during registration and are billed monthly or annually, as agreed. Unless otherwise specified:
All intellectual property rights in the Service — including software, algorithms, designs, documentation, trademarks, and service marks — are and shall remain the exclusive property of Hijaaz Latheef Corp. These Terms do not transfer any ownership rights to you.
You retain all rights to the data you upload to the platform. By uploading data, you grant us a limited, non-exclusive license to process that data solely for the purpose of delivering the Service.
Each party agrees to hold the other party's Confidential Information in strict confidence and not to disclose it to any third party except as necessary to perform obligations under these Terms. Confidential Information includes, without limitation, business plans, pricing, technical data, tenant information, and any materials marked as confidential.
This obligation shall survive termination of these Terms for a period of three (3) years.
We process personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. Key commitments include:
We commit to maintaining platform availability of 99.9% measured on a monthly basis, excluding scheduled maintenance windows. Our SLA commitments include:
Force majeure events — including natural disasters, cyberattacks, and government actions — are excluded from uptime calculations.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Hijaaz Latheef Corp. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Hijaaz Latheef Corp., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of:

We may suspend or terminate your account immediately and without notice if:
Upon termination, your access to the Service will cease, and we will delete your data within 90 days unless retention is required by law. You may request a data export prior to termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles.
Any dispute arising under or in connection with these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Austin, Texas. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Each party waives the right to participate in a class action lawsuit or class-wide arbitration.
